Real estate witnessed major reforms this year. Right from FDI to GST, the government has been trying to streamline the business environment to boost investors’ confidence. One of the biggest reforms came in the form of Real Estate Regulatory Authority (RERA). The Real Estate Regulatory Bill, when passed by both the houses of the Parliament earlier this year, promised many reformatory measures. RERA was one among them with a responsibility of easing the approval mechanism and check fraudulent activities into the sector. It was believed that Delayed Possession would soon become history.
Alas! RERA could not create much impact so far. Developers are still delaying possession; buyers are still on roads protesting against them. One of the recent examples was seen when the buyers of DB Realty’ DB Ozone project in Mumbai’s Dahisar, observed an e-Dharna; they protested against the developer over social media, especially on Twitter. The buyers association with Twitter handle @DBRealtyBuyers trended #Fight4Possession and tried to reach out to the developer and the authorities. This e-Dharna got support of #ThankUBuilders campaign as well.
Though the e-Dharna was a success, it could not wake up DB Realty’s management and the local authorities who are into a deep slumber since long. Disappointed by the reactions, the DB Realty Buyers Association finally decided to approach local administration for legal actions. They have so far filed more than 100 online applications to the local administrations. Unfortunately, they are yet to get revert.

Fahim Sutriwala, one of the aggrieved buyers of DB Realty’s DB Ozone, said, “We have approached the management more than 10 times in last one year. Every time they gave a new date and said that due to lack of funds they could not complete the construction. We do not understand that when we have paid almost all the amount, how they say they do not have funds. The last date that they gave was in the year 2015 which has also crossed”. The DB Realty Buyers Association said, “We are being cheated since last 7 years. There is no possession till date. We booked flats in 2009-2010 and agreement was done in 2010 with DB Realty Neelkamal Realtors Suburban Private Ltd which stated possession date as December 2014 with one year grace period. The grace period has also ended. No work is going on at the project site, only building structures are standing without any flooring, painting, electricity, and plumbing”.
It further said, “We have paid almost 90% of the payment till the year 2013 itself, but now builder is just giving fake dates and assurance. DB Realty is saying that they do not have funds but they are giving free Helicopter rides for their other project DB Crown. We are paying EMIs and staying on Rent. We just pray that we get the possession before our death”.
DB Realty Buyers Association is now planning to approach Shri Prakash Mehta, Minister of Housing, Government of Maharashtra and ask him to help get their flats. If that too fails, they would then approach Shri Devendra Fadnavis, Hon’ble Chief Minister of Maharashtra.
